three、建設(shè)單位有下列情形之一的,責令限期(qī)改正;逾期不改正的,責令項目停工,並處five萬元以(yǐ)上one0萬元以下的罰款:建設單位未依法提(tí)供工程款支付擔保;建設單位未按約定及時足額(é)向農民工工(gōng)資專用賬戶撥付工程(chéng)款中的人工費用;建設單位拒不提供或者無法提供工程施工(gōng)合同Migrant workers' wages專用賬(zhàng)戶有關資(zī)料(liào)。

機關、事(shì)業單位和大型(xíng)企業遲延支付中小企業款項的,應當支付(fù)逾期利息。雙方對逾期利息的(de)利率有約定的,約定利(lì)率不得低於合同訂立(lì)時oneyear期貸款市場(chǎng)報價利率;未(wèi)作約(yuē)定的,按照每日利率萬分之五支付逾期利息。

不得將保證金限定為現金。中小(xiǎo)企業以金融機構(gòu)保函提供保證的,機關、事業單位(wèi)和大型企業應當接受。

中小企業與機關、事業單位、大型(xíng)企業訂立合同時,應當主動告知其屬於中小企業。對(duì)中小企(qǐ)業規模(mó)類型(xíng)有爭議的,可以向主張為中小企業一方所在地(dì)的縣級以上地方人民政府負責中小企業促進工作綜合管理的部門申請認定。

有關行業、協會(huì)、商會應(yīng)當禁止本行業大型企業利(lì)用優勢地位拒絕或者遲延支付中小企業款項。

機關、事(shì)業單位和大(dà)型企業不得要求中小企業接受不合理的付款期限、方式、條(tiáo)件和(hé)違約責任(rèn)等交易條件,不得(dé)違約拖欠中小企業的貨(huò)物、工程、服務款項。

使用財政資金從中小企業采購貨物、工程、服務,應當嚴格按照批準的預算執行,不得無預算(suàn)、超預算開展采購。
