three、建設單位(wèi)有下列情形(xíng)之一的,責令限期改(gǎi)正;逾期不改(gǎi)正的,責令項目停工,並處five萬元以上one0萬元以下的罰款:建(jiàn)設(shè)單位未依法提供工程款支付擔保(bǎo);建設單位未按(àn)約定及時足額向農民工工資專用賬戶(hù)撥付工程款(kuǎn)中的人工費用;建設單位拒不提供或者無法提供工程施工合同Migrant workers' wages專用賬戶有關資料(liào)。
four、施工總承包單位職責:按照規定開設(shè)農民工工資專用賬戶(hù);存儲工資保證金,可以用金(jīn)融機構保函替代;與分(fèn)包單位依法訂立書麵分包合同,應當約定工程(chéng)款計量周期、工程款進度(dù)結算辦法;根據分包單位編製的工資支付表(biǎo),通過農民工工(gōng)資專用賬戶直接將工資支付到農民(mín)工本人的銀行賬戶,並向分包單位提供代發工資憑證;在工程項目部(bù)配備勞資專管員,對分(fèn)包單位勞動用工實施監督管理;轉包導致拖欠的,由施工總承(chéng)包單位先行清償,再依法進行追償;分包單(dān)位拖(tuō)欠農民工工資的(de),由施工總承包(bāo)單位先行清償,再依(yī)法進(jìn)行追償;施工單位(wèi)允許其他單位和個人以施工單位的名義對(duì)外承攬建設工程,導致拖欠農民工工資的,由(yóu)施工單位清償;在(zài)施工現場醒目位置設立維權信息告示牌(pái);與建(jiàn)設單位(wèi)因工程(chéng)數量、質量、造價等產生爭議的,不得不按照規定代發工資;建立用工管理台賬,並保存(cún)至工(gōng)程完工且工資全(quán)部結清後至少threeyear;工程完工且未拖欠農民工工資的,施工總(zǒng)承包單位公(gōng)示three0日後,可以申請注銷農民工工資專用賬戶,賬戶內餘額歸施工總承(chéng)包單位(wèi)所有(yǒu)。

機關(guān)、事業單位和大型企業遲延支付中小企業(yè)款項的,應當支付逾期(qī)利息。雙方對逾期利息的利率(lǜ)有約定的,約定利率不得低(dī)於合同訂立(lì)時oneyear期貸款市場報價利率;未作約定的,按照每日利率萬(wàn)分之五(wǔ)支付逾期(qī)利息。
使(shǐ)用商(shāng)業匯票等非現金支付方式支付中小企業款項(xiàng)的,應當在合同中(zhōng)作出明確、合理約定,不得(dé)強(qiáng)製中小企業(yè)接受商業匯票等非現金支付方式,不得利(lì)用商業匯票等非現金支付方式變相延長付款期(qī)限。
不得強製要求以審計機關(guān)的審計結果作為(wéi)結算依據,但合同另有約定或者法律、行(háng)政法規另有規定的除外。
不得將保證金限定為現金。中小(xiǎo)企業以金融機構保(bǎo)函提供保證的,機(jī)關、事業單位和大型企業應當接受。
中(zhōng)小企(qǐ)業與機關、事業單位、大型(xíng)企業訂立合同時,應當主動告知其(qí)屬於中小企業(yè)。對中小企業規模類型有爭議(yì)的,可以向主(zhǔ)張為中小(xiǎo)企業一方所在地的縣(xiàn)級以上地方人民(mín)政府負責中小企業促進工作綜合管理的部門申請認(rèn)定。
有關行業、協會、商(shāng)會應(yīng)當禁止本(běn)行業大型(xíng)企業利用優勢地位(wèi)拒絕或者遲延支付中小企業款項。
機關、事業單位和大型企業不(bú)得要(yào)求中小企業接受不合理的付款期限(xiàn)、方式、條件和違約責任等交易條件,不得違約拖欠中小企業的貨物、工程、服務款項。

改革(gé)後:工程勘察資質分為綜(zōng)合資質和專業資質;工(gōng)程設計資質分為綜合資質、行業資質、專業和事務所資(zī)質;施(shī)工資質分為綜合資質、施(shī)工總承包資質(zhì)、專業承(chéng)包資質和專業作(zuò)業資質(zhì);工程監(jiān)理(lǐ)資質分為(wéi)綜合資質和專業資質。資質(zhì)等級原則上壓減為(wéi)甲、乙兩級(部分資質隻設甲級或不分等級),資質等級壓減後,中小(xiǎo)企業(yè)承(chéng)攬業務(wù)範圍將進一步放寬,有利於促進中小企業(yè)發展。
文(wén)件還提到做好(hǎo)資質標準修(xiū)訂和換證工作,確保平穩過(guò)渡(dù),設置oneyear過渡期,到期後實行簡單換證,即按照新舊資質對應關係直接(jiē)換發新資質證書,不再(zài)重新核定資質。

明確:one、建築市場失信行為(wéi)信息實行分級管理,按照性質、危害程度的不同分為A級、B級、C級等失信等級。A級失信行為信(xìn)息的公開期限為six個month——threeyear;B級失信行為信息的公開期限為three個month——oneyear;C級失信行為信息的公(gōng)開期限為one個month——six個month。建築(zhù)市(shì)場主體“黑名單”信息管理期限為自被列入名單之日起oneyear。
